SMP Law is proud to share our successes in 2025!
We have prioritized our family law focus, while still staying in touch with civil and estate litigation. 2025 was a very busy year with family law, particularly with being a speaker at the PSAG conference and at various events on the topic of Parental Alienation.
A SiMPlified summary:
Cost: Total cost awarded IN FAVOUR of SMP Law’s clients in 2025 was $209,152.32.
Total cost awarded against SMP Law’s clients in 2025 was $4,091.81, however, $3,500 of this total is being disputed and will be determined by the Court of Appeal). As such, it is anticipated the total will be $591.81.
Motion: SMP Law had a total of fourteen (14) motions in 2025. SMP Law was successful in all but one, which is under appeal. The total court ordered cost payable to SMP Law’s clients by the losing party for these motions was $175, 976.32.
Appeals: 1 appeal in 2025. SMP Law was wholly successful. Cost SMP Law’s client received $2,500.00 in legal cost.
Trials: 2 trials in 2025. SMP Law was wholly successful in both. Total of fourteen (14) trial attendance days. Cost for one of these trials has yet to be determined as of this date.
Settled: Cases that settled in 2025 prior to the commencing the scheduled trial: Total of twelve (12) family files settled in 2025, preventing 53 scheduled trial days, and saving a total estimated $900K in legal fees to our clients.
A SiMPlified summary of some of our most notable cases for 2025:
Civil litigation Cases
1. Wholly successful on summary judgment motion with client receiving a judgment of $302,000.00 and successfully defended the defendant’s counterclaim. SMP Law’s client received $85,000.00 in legal cost.
2. Wholly successful on a contempt motion regarding refusal to return a party to the care of SMP Law’s client, and failure to pay court ordered cost totaling $31,427.50, and failure to provide disclosure. Cost and sentencing orders anticipated for 2026.
3. Wholly successful on a motion for enforcement of undertakings and refusals. SMP Law’s client received $2,500.00 in cost.
4. Wholly successful on a motion to compel debtor to attend appointment of financial examination and provide comprehensive financial disclosure. SMP Law’s client received $2,798.00 in cost.
Family Law Cases
1. Uncontested trial – SMP Law’s client received sole decision making, the father’s parenting time was restricted to supervised access at the sole discretion of SMP Law’s client. SMP Law’s client received $27,676.00 in legal cost.
2. Parental Alienation – successfully defended alienating parent’s attempt to delay implementation of final order and PC agreement. Court confirmed that the alienating parent acted unreasonable and that her motion was “ill conceived”, and as such, SMP Law was 100% successful on these motions. Result will have the alienating parent comply with the PC award’s penalty clauses resulting with her having to pay sanctions of over $80,000.00 due to her failure to allow the father parenting time with their son. In addition, SMP Law’s client received $23,783.11 in legal cost.
3. Withholding child/ engaging in self help – successful on urgent motion for the return of the child after father’s wrongful withholding of child for over 23 days. Father was found and declared in beach of the court order, as well as in breach of the final order’s financial disclosure terms. SMP Law’s client received $13,000.00 in cost.
4. Breach of order – successful on urgent motion for breach of order. SMP Law’s client received $10,000.00 in cost. On another matter, mother found failing to obey the spirit of the court order for her failure to encourage reunification therapy. SMP Law’s client received $6,100.00 in cost.
5. Motion to strike – successfully defended motion to strike. SMP Law’s client entitled to $11,545.21 in legal cost.
6. Severance of Divorce – SMP Law wholly successful in motion to sever divorce from corollary relief and was 100% successful in defending the cross motion for an amendment of child support. SMP Law client received $8,500.00 in legal cost.
7. Property – addressed motions seeking sale of matrimonial home and investment property and the immediate release of proceeds and successfully defended the cross motion requesting a preservation order. SMP Law’s client received $3,500.00 in legal cost.
8. Restraining order – successfully defended urgent motion for a restraining order. SMP Law’s client entitled to $1,500.00 in legal cost. On another matter, received a rare indefinite restraining order.
9. Shared parenting time – successful urgent case conference, prior to the completion of pleadings, father received shared parenting and parenting time. On another motion, received a consent order for shared parenting and parenting time.
10. Urgent motions prior to service of Divorce Application – successful on an urgent motion (prior to the pleadings being served) enforcing the status quo prior to separation and preventing the mother from removing the child from the jurisdiction and confirming that the parents have shared parenting responsibilities and shared parenting time. SMP Law received Cost in the cause.
11. Father’s motion to relocate with children – successful in having a timeline put in place for children residing with father in Toronto. Judge confirmed that SMP Law’s motion was needed and led to clarity on what shared parenting schedule co be for the separating couple. Despite SMP Law client’s request for the immediate move to Toronto was not granted, no cost was awarded against SMP Law’s client.

1 – There are costs associated with any type of legal dispute and those costs will include things like lawyer fees, court filing fees, fees for experts or witnesses and any other necessary costs connected to the legal matter. It is up to the judge’s discretion to decide whether they award either person with costs – meaning the other side is required to pay you some or all of your legal expenses. It is important to know that even if a judge decides to award you costs, you do not always get all of your money back as there are many factors that go into a judge’s decision.
