Does a Parent/Child Dispute Impact Child Support?

The general rule is that a child, under the age of majority, has a right to receive child support. As such, in this case, it does not matter whether the child and the parent get along or are in a dispute. In Canadian Law, child support is the right of the child not the parent.

SMP Law – Update on Unconscionability

In 2020, SMP Law wrote a post about dividing property and SMP Law was successful in the Superior Court case where the court agreed with my client that it was unconscionable to award his spouse 50% of the property and assets. Instead she only received 10% of the assets and property that she was seeking.

Can My Ex Spouse Force Me to Pay for Private School Expenses?

In a recent case the father retained SMP Law to help with his situation where the mother was putting the child into a private school without his consent and demanding his share of the costs for the private school be considered a section 7 expense.
